These Terms of Service govern your use of breezeofjoyfoundation.org and any related services operated by Breeze of Joy Foundation, a 501(c)(3) nonprofit (EIN: 86-3212923) incorporated in California. By using our website or donating, you agree to these Terms.

1. About Breeze of Joy Foundation

Breeze of Joy Foundation is a tax-exempt nonprofit under Section 501(c)(3) of the Internal Revenue Code, registered with the California Attorney General's Registry of Charitable Trusts. We are 100% volunteer-run with zero overhead or administrative salaries.

2. Use of Our Website

You agree not to: violate any applicable laws; attempt unauthorized access to our systems; transmit spam or malware; misrepresent your identity; scrape or copy our content without permission; or use our name or logo without written consent.

3. Donations

a) Tax Deductibility

All donations are tax-deductible to the extent permitted by US law. Donors outside the US should consult their local tax advisor.

b) Use of Donations

100% of all donations go directly to girls' education — covering tuition, books, supplies, and uniforms. All operational costs are borne personally by our volunteer founders.

c) No Refund Policy

All donations are final and non-refundable. If you believe a donation was made in error, contact us within 7 days at [email protected] and we will review your request.

d) Recurring Donations

By setting up a recurring donation, you authorize charges on the agreed schedule. You may cancel at any time by contacting us or through your Zeffy donor account.

e) Payment Processing

Donations are processed through Zeffy, a zero-fee donation platform. We do not store your payment card information. By donating, you also agree to Zeffy's terms at zeffy.com.

4. Intellectual Property

All website content — including text, images, logos, and videos — is the property of Breeze of Joy Foundation and protected by US and international copyright law. You may not reproduce or distribute our content without written permission, except for nonprofit advocacy with proper attribution.

5. Privacy of Sponsored Girls

Photos and stories of sponsored girls are shared with guardian consent for fundraising purposes only. These images may not be used, downloaded, or reproduced without explicit written permission from Breeze of Joy Foundation.

6. Disclaimer of Warranties

Our website is provided "as is" without warranties of any kind. We do not warrant that the website will be uninterrupted or error-free.

7. Limitation of Liability

To the fullest extent permitted by law, Breeze of Joy Foundation and its volunteers shall not be liable for any indirect, incidental, or consequential damages arising from your use of our website. Our total liability shall not exceed the amount of your most recent donation.

8. International Use

Our website is operated from the United States. If you access it from outside the US, you are responsible for compliance with your local laws. Donors from OFAC-sanctioned countries may be unable to donate.

9. Governing Law

These Terms are governed by the laws of the State of California. Any disputes shall be resolved in the courts of Orange County, California.

10. Dispute Resolution

We encourage informal resolution first. Unresolved disputes shall be settled by binding arbitration in Orange County, CA under American Arbitration Association rules, except either party may seek injunctive relief for IP violations.

11. Changes to Terms

We may update these Terms at any time. Continued use of our website after changes constitutes acceptance of the updated Terms.
